Terms of Service
The operating terms that govern engagement with Mtambo Holdings Group products and services.
1. Acceptance of Terms
By accessing and using services, websites, or software products offered by Mtambo Holdings Group (Pty) Ltd (CIPC Reg No: 2026/614054/07, Tax No: 9089227301, CSD Supplier No: MAAA1753097, B-BBEE Level 1 Contributor), you agree to these Terms of Service. If you do not agree, please discontinue use of our services.
2. Services
Mtambo Holdings Group provides digital infrastructure, software architecture, branding, and CRM-related solutions. Service scope, timelines, and deliverables are defined in written agreements with each client.
3. Client Responsibilities
Clients must provide accurate project information, required approvals, and timely feedback. Delays in communication or required assets may affect delivery schedules.
4. Payments and Billing
Fees, milestones, and payment dates are governed by each client agreement. Late payments may result in service suspension or delayed delivery until outstanding balances are resolved.
5. Intellectual Property
Unless otherwise agreed in writing, Mtambo Holdings Group retains ownership of proprietary frameworks, templates, and internal tooling. Client-specific deliverables are transferred according to contractual terms after full payment.
6. Confidentiality
Both parties agree to protect confidential information shared during engagements. Sensitive business, technical, or strategic data may not be disclosed without prior written consent, except where legally required.
7. Limitation of Liability
Mtambo Holdings Group is not liable for indirect, incidental, or consequential damages arising from service use, platform downtime, third-party provider failures, or loss of business opportunity.
8. Termination
Either party may terminate service relationships in accordance with the governing agreement. Fees for completed work and approved milestones remain payable upon termination.
9. Governing Law
These Terms are governed by the laws of the Republic of South Africa, unless otherwise specified in a signed contract.
10. Updates
We may revise these Terms from time to time to reflect legal, operational, or service changes. Continued use of our services after updates constitutes acceptance of the revised Terms.
