End User License Agreement
These EULA terms govern your use of Mtambo Holdings Group software, platforms, and deliverables.
1. License Grant
Subject to these terms, Mtambo Holdings Group (Pty) Ltd (CIPC Reg No: 2026/614054/07, Tax No: 9089227301, CSD Supplier No: MAAA1753097, B-BBEE Level 1 Contributor) grants you a limited, non-exclusive, non-transferable licence to use our website, services, and any deliverables provided under a separate agreement for lawful purposes only.
2. Usage Restrictions
You shall not reproduce, modify, distribute, sell, lease, or create derivative works of our software, design assets, or deliverables except as expressly permitted in a signed agreement.
3. Intellectual Property
All intellectual property rights in the platform, source code, design systems, and underlying technologies are retained by Mtambo Holdings Group unless otherwise assigned in writing.
4. Warranties and Disclaimers
EXCEPT AS EXPRESSLY PROVIDED IN A WRITTEN AGREEMENT, THE SERVICES AND DELIVERABLES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, MTAMBO HOLDINGS DISCLAIMS ALL IMPLIED WARRANTIES.
5. Limitation of Liability
MTAMBO HOLDINGS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR AGGREGATE LIABILITY FOR DIRECT DAMAGES SHALL BE LIMITED TO THE FEES PAID FOR THE RELEVANT SERVICES.
6. Indemnification
You agree to indemnify and hold Mtambo Holdings Group harmless from any claims, losses, or liabilities arising from your misuse of the services or breach of this EULA.
7. Termination
Mtambo Holdings Group may suspend or terminate access to services on material breach. Termination does not relieve either party of obligations accrued prior to termination.
8. Governing Law
This EULA shall be governed by the laws of the Republic of South Africa. Disputes may be referred to the competent courts of South Africa.
9. Changes to EULA
We may modify this EULA from time to time. Updated terms will be posted on this page with the effective date. Continued use after changes constitutes acceptance.
